Terms of service

  1. 01

    The service

    ThumbnailCreator (“we”, “us”) generates images from text prompts and optional reference images using third-party AI models, through the website, an MCP server, an Agent Skill and x402 pay-per-call endpoints. By using any of these you accept these terms.

  2. 02

    Accounts and API keys

    You must be at least 18. You are responsible for activity on your account and for every request made with your API keys, including requests made by agents you configure. Keep keys secret and revoke any key you believe is exposed.

  3. 03

    Pricing and billing

    Each generated image is charged at the per-image price shown for its model when the request is made. Prices are set per model, include our margin over the model provider's cost, and may change for future requests. You buy $10 credit packs. Accounts created before October 20, 2026 keep any unused free allowance. Credit packs are paid once in USD. Credits never expire. Failed images are not charged. Taxes are added where required.

  4. 04

    Pay-per-call (x402)

    Requests paid with x402 are charged the quoted amount in USDC on the stated network before the response is returned. Payment settles only if every image in the request is produced; if any image fails or the request times out, nothing is charged and any finished images are still returned. Blockchain payments are final and cannot be refunded on-chain.

    Refunds

    Credit pack purchases are final and unused credits are not refundable. Packs bought before October 17, 2026 keep the refund terms they were bought under. If something was charged in error, email support@thumbnailcreator.ai within 30 days and we will correct it. If we discontinue the service, we will email account holders at least 30 days before it closes and refund any unused purchased credit when it does. Nothing here limits rights you have under consumer protection law.

    Your content and generated images

    You keep your rights in prompts and uploads and must have the right to use them, including any likeness of real people. To the extent we have any rights in the images you generate, we assign them to you. AI output can be similar to other people's output, and we make no promise that it is unique or free of third-party rights. You are responsible for how you use it.

  7. 07

    Acceptable use

    Do not use the service to create illegal content, sexual content involving minors, non-consensual intimate or deceptive imagery of real people, content that infringes others' rights, or to abuse, overload or resell access to the service without permission. Model providers apply their own safety filters. We may suspend accounts, keys or wallets that break these rules.

  8. 08

    Third-party models

    Generation runs on models from providers such as OpenAI, Google, Black Forest Labs, ByteDance, Ideogram and xAI through Replicate. Their availability, behaviour and content policies are outside our control, and models may be added, changed or removed.

  9. 09

    Disclaimer and liability

    The service is provided “as is”, without warranties of any kind. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to what you paid us in the three months before it.

  10. 10

    Changes, termination and law

    We may update these terms and will change the date above. Using the service after an update means you accept the updated terms. You may stop using the service or close your account at any time. Closing your account forfeits any remaining balance unless you ask us to honour it before closing. These terms are governed by the laws of Ontario, Canada.

Privacy policy

    What we collect

    Your email address and sign-in data; prompts, uploaded reference images and generated images; usage and billing records; API key metadata (we store only a hash of each key); for x402 requests, the paying wallet address; and basic technical data such as IP address and browser type. Card details are handled by Stripe, never by us.

  2. 02

    How we use it

    To run the service, generate and store your images, bill usage, prevent abuse, provide support, and understand aggregate product usage. We do not sell personal information and do not use your images to train models.

  3. 03

    Who processes it

    Supabase (authentication, database, file storage), Replicate and the model providers it routes to (generation), Stripe (payments), Coinbase or the x402 facilitator (on-chain settlement), Render and Cloudflare (hosting), and Humblytics (privacy-focused analytics). Data may be processed outside Canada.

  4. 04

    Retention

    Generated images and history stay in your account until you delete them or close your account. Billing records are kept as long as tax law requires. Links to images expire after one hour and are re-issued on request.

  5. 05

    Your rights

    You can ask to access, correct, export or delete your data, or close your account, by emailing support@thumbnailcreator.ai. We reply within 30 days.
